Terms of Service

1. Acceptance of Terms

By creating an account or using BriefPort ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

BriefPort provides a requirements management platform that uses AI to analyze client evidence (chat logs, documents, audio files), generate structured requirements, and facilitate client confirmation workflows. The Service includes project management, evidence storage, AI-powered analysis, requirement versioning, and export capabilities.

3. Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information at registration.
  • One person or entity may not create multiple free-tier accounts to circumvent usage limits.

4. Acceptable Use

You agree not to:

  • Upload content that is illegal, infringes intellectual property, or contains malware
  • Attempt to access, tamper with, or disrupt the Service's infrastructure
  • Reverse engineer, decompile, or extract the Service's source code
  • Use the Service to store or transmit content that violates applicable law
  • Resell or sublicense access to the Service without written permission
  • Inject malicious instructions into uploaded evidence (prompt injection attacks)

We reserve the right to suspend or terminate accounts that violate these rules.

5. AI Processing Disclaimer

BriefPort uses AI models to analyze your uploads and generate requirements. You acknowledge that:

  • AI-generated outputs may contain errors, omissions, or hallucinations.
  • AI outputs are suggestions, not decisions. Human review is required before acting on any AI-generated requirement.
  • Client confirmation records produced by the Service are business communication records, not legally certified electronic signatures.
  • BriefPort is not liable for damages resulting from reliance on AI-generated content without human verification.

6. Subscriptions & Billing

  • Subscriptions are billed monthly via Creem in USD.
  • Free tier includes limited credits; paid tiers include credits and project slots per the pricing page.
  • Credits reset monthly and do not roll over.
  • You can upgrade, downgrade, or cancel at any time. Downgrades take effect at the next billing cycle.
  • Refunds are issued at our discretion for service outages exceeding 24 hours.
  • Overage charges apply per the overage policy configured on your account.

7. Your Content

You retain all rights to content you upload to BriefPort ("Your Content"). You grant BriefPort a limited license to process Your Content solely for providing the Service (including sending it to AI model providers for analysis).

Upon account deletion, Your Content is permanently removed within 30 days.

8. Intellectual Property

The BriefPort platform, including its design, code, and brand, is the intellectual property of BriefPort. You may not copy, modify, or distribute it without permission.

9. Service Availability

We strive for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance is announced at least 24 hours in advance. We are not liable for downtime caused by factors outside our control (cloud provider outages, network failures, etc.).

10. Limitation of Liability

To the maximum extent permitted by law, BriefPort is not liable for:

  • Indirect, incidental, or consequential damages
  • Data loss (you are responsible for backing up critical data)
  • Damages from AI-generated errors that were not caught by human review
  • Damages exceeding the amount you paid in the preceding 12 months

11. Indemnification

You agree to indemnify BriefPort against claims arising from Your Content or your violation of these Terms.

12. Termination

You can delete your account at any time. We may suspend or terminate your account for violations of these Terms. Upon termination, your data is deleted per our Privacy Policy retention schedule.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms. Material changes will be notified by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
